According to regulators, office and home working arrangements should be the same, crisis or not.

The firms should have the new normal embedded to their culture, their policies updated, their training refreshed, and rigorous oversight put in place – particularly regarding the risk of use of privately owned devices. New communications mechanisms, before they are used, should have controls in place where required and their use approved by firm management.

The simplest way to circumvent all existing controls is to use a personal mobile phone.

In 2010, the FCA said in their Consultation Paper that mobile phones and mobile communications were excluded from
their Taping Rules because the technology to capture these communications was insufficiently developed. In 2020, this statement no longer stands, as the technology to manage any mobile device to deliver compliance in restricted areas is here.
